§ 1 Information about the collection of personal data

(1) In the following we provide information about the collection of personal data when using our website. Personal data are all data that can identify you personally, e.g. name, address, e-mail addresses, user behaviour.

(2) The Responsible Person according to Art. 4 Sec. 7 EU General Data Protection Regulation (GDPR) is Lutz Fleischhacker, An der Silberkuhle 18, 58239 Schwerte (see our imprint). (3) When you contact us by e-mail or via a contact form, the data you provide (your e-mail address, if applicable, your name) will be stored by us in order to answer your questions. The provision of further information like address or phone number is voluntary and only makes it easier for us to contact you in order to answer your enquiry. We delete the data arising in this context when storage is no longer necessary, or limit processing if statutory retention obligations exist.

(4) If we use contracted service providers for individual functions of our offer or want to use your data for advertising purposes, we will inform you in detail about the respective processes in the following. Here, we also specify the defined criteria for the storage period.

 

§ 2 Your rights

(1) You have the following rights with regard to your personal data:

  • Right to information
  • Right to correction or deletion,
  • Right to limiting processing,
  • Right to appeal against processing,
  • Right to data transferability.

(2) You also have the right to complain to a data protection supervisory authority about our processing of your personal data.

 

§ 3 Collection of personal data when you visit our website

(1) When using the website for information purposes only, i.e. if you do not register or otherwise provide us with information, we only collect the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data, which are technically necessary for us to display our website to you and to guarantee stability and security (legal basis is Art. 6 Sec. 1 S 1 lit. f GDPR):

  • Date and time of the request
  • Time difference to Greenwich Mean Time (GMT)
  • Content of request (actual page)
  • Access status/HTTP status code
  • Respective transferred data volume
  • Website from which the request is sent
  • Browser
  • Operating system and its interface
  • Language and version of the browser software


(2) In addition to the aforementioned data, cookies are stored on your computer when you use our website. Cookies are small text files stored on your hard disk in the browser used by you and through which certain information flows to the point that places the cookie (in this case, our company). Cookies cannot execute programs or transmit viruses to your computer. They serve to make the Internet offer more user-friendly and effective overall.

(3) Use of cookies:

a) This website uses the following types of cookies, the scope and functionality of which are explained below:

              - Transient cookies (see b)
               - Persistent cookies (see c).

b) Transient cookies are automatically deleted when you close your browser. In particular this includes the session cookies. These store a so-called session ID, with which different requests of your browser can be assigned to the common session. This will allow your computer to be recognised again when you return to our website. The session cookies are deleted when you log out or close your browser.

c) Persistent cookies are automatically deleted after a specified period, which may vary depending on the cookie. You can delete cookies at any time via the security settings of your browser.

d) You can configure your browser settings according to your wishes and, for example, refuse the acceptance of third party cookies or all cookies. Please note that you may then not be able to use all functions of this website.
 

 

§ 4 Further functions and offers of our website

(1) In addition to the purely informational use of our website, we offer various services that you can use if you are interested. As a rule, you must then provide further personal data, which we use to provide the respective service and to which the aforementioned data processing principles apply.

(2) In some cases we use external service providers to process your data. These have been carefully selected and commissioned by us, are bound by our instructions and are checked regularly.

(3) Furthermore, we may pass on your personal data to third parties if we offer special promotions, competitions, contracts or similar services together with partners. You will receive more detailed information on this upon providing your personal data or in the description of the offer given in the following.

(4) If our service providers or partners are based in a country outside the European Economic Area (EEA), we will inform you of the consequences of this circumstance in the description of the offer.

 

§ 5 Objection or revocation against the processing of your data

 (1) If you have given your consent to the processing of your data, you can revoke this at any time. Such a revocation affects the permissibility of processing your personal data after you have notified us of this.

 (2) If we base the processing of your personal data on a balancing of interests, you may object to the processing. This is the case, in particular, if processing is not necessary to fulfil a contract with you, which is described by us in the following description of the functions. When exercising such an objection, we ask you to explain the reasons why we should not process your personal data as we have. In the event of your justified objection, we will examine the situation and either stop or adjust data processing or point out to you our compelling reasons worthy of protection, on the basis of which we will continue processing.

(3) Of course, you can object to the processing of your personal data for purposes of advertising and data analysis at any time. § 6 Use of our web shop

 (1) If you wish to order from our web shop, it is necessary for the conclusion of the contract that you enter your personal data we need to process your order. The necessary mandatory information for the execution of the contracts is marked separately, further information is voluntary. We process the data provided by you to execute your order. For this purpose we can pass on your payment data to our house bank. The legal basis for this is Art. 6 Sec. 1 S. 1 lit. b GDPR.

You can voluntarily create a customer account through which we can store your data for future purchases. When you create an account under "My account", the data you have provided will be stored revocably. All other data, including your user account, can always be deleted by you in the customer area.

We may also process the information you provide to inform you of other interesting products in our portfolio or to send you e-mails containing technical information.

(2) We are obliged by commercial and tax regulations to store your address, payment and order data for a period of ten years. However, after [two years] we limit processing, i.e. Your data will only be used to comply with legal obligations.

(3) To prevent unauthorised access by third parties to your personal data, especially financial data, the order process is encrypted using TLS technology.  

 

§ 7 Newsletter

 (1) With your consent, you can subscribe to our newsletter, in which we inform you about our current interesting offers. The showcased goods and services are named in the declaration of consent.

(2) For the registration to our newsletter we use the so-called double opt-in procedure. This means that after your registration we will send you an e-mail to the specified e-mail address in which we ask you to confirm that you would like the newsletter to be sent. If you do not confirm your registration within 24 hours, your information will be blocked and automatically deleted after one month. In addition, we store your IP addresses used and the time of registration and confirmation. The purpose of the procedure is to be able to prove your registration and, if necessary, to clarify a possible misuse of your personal data.

(3) The only mandatory information for sending the newsletter is your e-mail address. The indication of further, separately marked data is voluntary and is used to be able to address you personally. After your confirmation we will store your e-mail address for the purpose of sending you the newsletter. The legal basis for this is Art. 6 Sec. 1 S. 1 lit. a GDPR.

(4) You can revoke your consent to receive the newsletter at any time and unsubscribe from the newsletter. You can declare your revocation by clicking on the link provided in every newsletter e-mail, via this form on the website, by e-mail to privacy@fleischhacker.biz or by sending a message to the contact details stated in the imprint.

 


§ 8 Use of Google Analytics

 (1) This website uses Google Analytics, a web analysis service of Google Inc. ("Google“). Google Analytics uses "cookies", which are text files placed on your computer, to enable an analysis of how you use the website. The information generated by the cookie about your use of this website is usually transferred to a Google server in the USA and stored there. However, if IP anonymisation is activated on this website, Google will abbreviate your IP address within Member States of the European Union or in other states party to the Agreement on the European Economic Area beforehand. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and abbreviated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide the website operator with further services associated with website and Internet use.

(2) The IP address transmitted by your browser in the context of Google Analytics is not merged with other Google data.

(3) You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. (4) This website uses Google Analytics with the extension "_anonymizeIp()". As a result, IP addresses are further processed in abbreviated form, so that a personal reference can be excluded. (5) We use Google Analytics to analyse and regularly improve the use of our website. We can improve our offer and make it more interesting for you as a user via the obtained statistics. (7) This website also uses Google Analytics for a device-independent analysis of visitor traffic, which is performed via a user ID. You can deactivate the cross-device analysis of your usage in your customer account under "Account data".

 

§ 9 Use of Google Adwords Conversion

(1) We use the offer of Google Adwords to draw attention to our attractive offers with the help of advertising materials (so-called Google Adwords) on external websites. By correlating the data of the advertising campaigns we can determine how successful the individual advertising measures are. We are interested in showing you advertising that is of interest to you, to make our website more interesting for you and to achieve a fair calculation of advertising costs.

(2) These advertising media are delivered by Google via so-called "Ad Servers". For this purpose, we use Ad Server cookies, through which certain parameters for measuring success, such as the insertion of ads or clicks by users, can be measured. Insofar as you access our website via a Google ad, Google Adwords stores a cookie on your PC. These cookies usually expire after 30 days and are not intended to identify you personally. For this cookie, the unique cookie ID, number of ad impressions per placement (frequency), last impression (relevant for post-view conversions) and opt-out information (marker that the user no longer wishes to be addressed) are usually stored as analysis values.

(3) These cookies enable Google to recognise your Internet browser again. If a user visits certain pages of an Adwords customer's website and the cookie stored on their computer has not expired, Google and the customer can recognise that the user has clicked on the ad and has been redirected to this page. Each Adwords customer is assigned a different cookie. Cookies cannot therefore not be traced via the websites of Adwords customers. We ourselves do not collect and process any personal data in the aforementioned advertising measures. We only receive statistical analyses from Google. On the basis of these analyses, we can identify which of the advertising measures used are particularly effective. We do not receive any further data from the use of advertising material; in particular, we cannot identify users on the basis of this information.

(4) Due to the marketing tools used, your browser automatically establishes a direct connection to the Google server. We have no influence on the extent and the further use of the data which are collected by the use of this tool by Google and therefore inform you according to our level of knowledge: By the integration of AdWords Conversion, Google receives the information that you have called the corresponding part of our Internet presence or clicked on an advertisement from us. If you are registered with a Google service, Google may match your visit to your account. Even if you are not registered with Google or have not logged in, it is possible that the provider may obtain and store your IP address.

(5) You can prevent participation in this tracking process in various ways: a) by setting your browser software accordingly, in particular by suppressing third-party cookies, you will not receive any ads from third-party providers; b) by deactivating cookies for conversion tracking, by setting your browser so that cookies are blocked by the domain "www.googleadservices.com", https://www.google.de/settings/ads, whereby this setting is deleted when you delete your cookies; c) by deactivating the interest-based ads of the providers that are part of the "About Ads" self-regulation campaign via the link http://www.aboutads.info/choices, whereby this setting is deleted when you delete your cookies; d) by permanently deactivating Firefox, Internet Explorer or Google Chrome in your browsers under the link http://www.google.com/settings/ads/plugin. We wish to point out that in this case you may not be able to use all functions of this offer in full.
